Title
Amending Title 10 of The Philadelphia Code, entitled “Regulation of Individual Conduct and Activity,” by adding prohibitions and penalties related to litter near mobile providers of goods, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
SECTION 1. Title 10 of The Philadelphia Code is hereby amended as follows:

(12)   In addition to any penalty applicable under Section 10-719(1), a violator of any provision of Section 10-727 (Litter Near Mobile Providers of Goods) shall be liable for all costs incurred by the City for cleanup where a violation has occurred.

§ 10-727. Litter Near Mobile Providers of Goods
 
(1)                     Definitions.
 
(a)                     Mobile Provider of Goods. A person or entity that distributes tangible goods to members of the public while operating within the public right-of-way, including but not limited to when such distribution is carried out from a vehicle. For purposes of this Chapter, a mobile provider of goods includes but is not limited to a street vendor as defined in Section 9-203.
 
(2)                     Requirement to Remove Litter Surrounding Mobile Provider of Goods. Prior to departing from a location at which a mobile provider of goods has distributed goods, such mobile provider of goods shall remove all litter within a surrounding fifty (50) foot radius of where they have performed a distribution of goods.
 
(3)                     Applicability. This requirement shall apply in the First and Seventh Council Districts.
 
 
SECTION 2. This Ordinance shall take effect thirty (30) days following adoption into law.
