Amending Chapter 9-6300 (“Consumer Protection Ordinance”) of The Philadelphia Code to clarify the statute of limitations and provide for retroactivity, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1.   Title 9 of The Philadelphia Code is hereby amended to read as follows:
 
TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS

CHAPTER 9-6300. CONSUMER PROTECTION ORDINANCE.

§ 9-6306. Statute of limitations. A claim for a violation of this Chapter must be filed in court within six years of the date that an alleged violation occurred.
 
§ 9-6307. Retroactivity. This Chapter shall apply retroactively to any conduct that occurred up to six years before the date of enactment of this Section, provided that at the time such conduct occurred it would also constitute a violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Law, 73 P.S. § 201-1 et seq.
 
SECTION 2.                     This Ordinance shall become effective immediately.
