Amending Chapter 9-600 (“Service and Other Businesses”) of The Philadelphia Code to add requirements that retail customer parking lots maintain video surveillance of parking areas, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
SECTION 1.   Title 9 of The Philadelphia Code is hereby amended to read as follows:

§ 9-601. Garages, Parking Lots, Sales Lots and Sales Showrooms. 
 
(1)                     General Provisions.
 
(a)                     Definitions. In this Section the following definitions apply:

         (.8) Retail Customer Parking Lot. Any outdoor area or space, or any building or other structure, in which motor vehicles may be parked, stored, housed or kept, and which is reserved for use by customers of a retail establishment that does business under the same trade name as used by ten (10) or more other establishments (whether such other establishments are located in the City or elsewhere and regardless of the type of ownership of each individual establishment).

(9) Video Surveillance Requirement.
 
(a)                     A retail customer parking lot must maintain video surveillance of the parking area which satisfies all the following requirements:
 
(.1) Visual coverage of at least 80 percent of the area where motor vehicles may be parked;
 
(.2) Minimum video resolution of 1280x720 pixels (700 P);
 
(.3) Infrared imaging to enable nighttime recording; and
 
(.4) Vandal-resistant cameras.
 
(b)                     Video footage collected pursuant to Subsection (9)(a) must be retained by the public parking lot, public garage, or customer parking lot for a minimum of thirty (30) days and must be made available to law enforcement upon request, as consistent with applicable law.
 
SECTION 2.                     This Ordinance shall become effective immediately.
